Terms of Use

1. About These Terms

1.1 These Terms of Use govern access to and use of the YB Tracking website (www.ybtracking.com), Race Viewer, Race Viewer Pro, associated applications, tracking pages, embedded viewers, APIs, data feeds and related services (collectively referred to as the "Services").

1.2 The Services are operated by Ground Control Technologies UK Ltd, trading as YB Tracking, a company registered in England and Wales under company number 05240202, with its registered office at Unit D2, Churcham Business Park, Churcham, Gloucestershire, GL2 8AX, United Kingdom ("YB Tracking", "we", "us" or "our").

1.3 By accessing or using the Services, you agree to comply with these terms. If you do not agree, you must not use the Services.

1.4 Where you access the Services on behalf of a company, organisation or other legal entity, you confirm that you have the authority to accept these terms on its behalf.

1.5 Where a separate written agreement exists between YB Tracking and an event organiser, participant, mapping provider, commercial partner or other authorised party, that agreement takes precedence over these terms to the extent of any conflict.

2. Definitions

For the purposes of these terms:

2.1 Tracking Data means all GPS positions, geographical coordinates, timestamps, speeds, headings, distances, rankings, timing information, telemetry, race progress, environmental information and other event-related data collected, processed, transmitted, stored or displayed through the Services, whether live, delayed, historical or archived, including compilations and derived datasets.

2.2 Site Content means the software, maps, visualisations, race replays, graphics, leaderboards, interfaces, text, images, logos, branding and other content made available through the Services.

2.3 Database means the structured collection of Tracking Data obtained, verified, organised, maintained or presented by YB Tracking through its tracking systems and Services.

2.4 Automated Means includes robots, crawlers, scrapers, scripts, headless browsers, automated API requests, data-mining tools, browser extensions and any other automated methods used to access, extract, monitor or collect information.

2.5 Commercial Use means any use connected with a business, commercial service or revenue-generating activity, including redistribution, resale, advertising-supported publication, third-party tracking services, analytics products and commercial data processing.

2.6 Authorised Partner means an event organiser, mapping provider, broadcaster, media organisation or other party granted express written permission by YB Tracking to access or use specified Tracking Data or Services.

3. Intellectual Property and Database Rights

3.1 YB Tracking makes substantial ongoing investment in obtaining, verifying, organising, maintaining and presenting Tracking Data. This includes tracking equipment, satellite and cellular communications, data infrastructure, processing, verification, software development and live event presentation.

3.2 To the extent applicable, the Database is protected by database rights under the Copyright and Rights in Databases Regulations 1997, as amended, and other applicable intellectual property laws.

3.3 YB Tracking and its licensors retain all applicable copyright, database rights, trademarks and other intellectual property rights in the Database, Site Content, software, interfaces, branding and proprietary systems.

3.4 Individual GPS coordinates, factual race results or independently obtained information are not claimed to be exclusively owned by YB Tracking merely because they appear within the Services. However, access to and use of YB Tracking's proprietary databases, systems, feeds and compilations remain subject to applicable intellectual property rights and these terms.

3.5 Nothing in these terms transfers ownership of any intellectual property rights to users or grants rights beyond those expressly permitted.

3.6 Event organisers and other third parties may retain independent rights in event information, branding and other materials supplied to YB Tracking. Such rights do not automatically grant permission to extract or redistribute YB Tracking's proprietary databases, data feeds or software.

4. Permitted Use

4.1 Subject to these terms, YB Tracking grants users a limited, non-exclusive, non-transferable and revocable permission to access and view publicly available Tracking Data through the official YB Tracking website, Race Viewer, Race Viewer Pro and authorised applications.

4.2 Users may share links to publicly available tracking pages through websites, social media, email and other communication channels.

4.3 Occasional screenshots may be shared for personal, editorial or non-commercial promotional purposes, provided that:

•    YB Tracking branding and attribution remain visible.
•    The content is not materially altered or misrepresented.
•    The screenshots are not used to create or operate an alternative tracking service.
•    The use does not infringe third-party rights or breach applicable event restrictions.

4.4 Authorised embedding of the official YB Tracking viewer is permitted only through embedding functionality made available or expressly approved by YB Tracking and subject to any applicable conditions.

4.5 Search engines may index publicly accessible pages in accordance with our published robots.txt instructions for the purpose of providing ordinary search results. Such permission does not authorise bulk extraction, harvesting or republication of Tracking Data.

4.6 Participants, teams, event organisers, broadcasters and commercial partners requiring additional access or data usage rights must obtain permission under a separate written agreement where those rights are not already granted.

5. Prohibited Use of Tracking Data

5.1 Except where expressly authorised in writing by YB Tracking, or where permitted by applicable law notwithstanding these terms, users must not:

a. Automated Extraction
Use Automated Means to access, scrape, harvest, collect, download or systematically monitor Tracking Data or Site Content.

b. Database Extraction
Extract or reutilise all or a substantial part of the Database, or repeatedly and systematically extract or reutilise insubstantial parts in circumstances that infringe applicable database rights.

c. Unauthorised Redistribution
Copy, republish, retransmit, stream, distribute, sublicense or otherwise make Tracking Data available through another website, application, platform, broadcast, database or commercial service.

d. Competing Tracking Services
Use Tracking Data, whether obtained directly or indirectly from the Services, to create, operate, support or enhance any independent or competing tracking, mapping, race monitoring, leaderboard, analytics or event information service.

e. Commercial Exploitation
Sell, license, monetise or otherwise commercially exploit Tracking Data or Site Content without prior written authorisation.

f. Artificial Intelligence and Machine Learning
Use Tracking Data or Site Content to train, fine-tune, evaluate, test, ground or develop artificial intelligence, machine learning or automated analytical systems without express written permission.

g. Unauthorised API Access
Access, query or extract information from undocumented APIs, XML feeds, data files, server endpoints or other data delivery mechanisms without authorisation.

h. Removal of Attribution
Remove, conceal, modify or interfere with YB Tracking branding, copyright notices, watermarks, attribution or other rights information.

i. Circumvention of Technical Measures
Bypass, disable, interfere with or attempt to circumvent authentication systems, access restrictions, rate limits, bot detection, security measures or other technical protections.

j. Excessive System Usage
Use the Services in any manner that disrupts operations, compromises security or imposes unreasonable demands on YB Tracking's infrastructure.

k. Unauthorised Transfer
Sell, sublicense, assign or transfer access credentials, API keys, data feeds or other restricted access rights to third parties.

5.2 These restrictions apply to live, delayed, historical and archived Tracking Data, including data obtained indirectly from third parties where its use would otherwise breach these terms or applicable intellectual property rights.

5.3 The conclusion of a race, event or commercial agreement does not automatically grant permission to extract, redistribute or commercially exploit archived Tracking Data.

5.4 Nothing in these terms restricts rights or statutory exceptions that cannot lawfully be excluded or limited by contract.

6. Event Organisers and Third-Party Data Use

6.1 YB Tracking works with event organisers, race management companies, mapping providers, broadcasters and other commercial partners to deliver tracking and event presentation services.

6.2 An event organiser's permission to use its own event information does not, by itself, authorise a third party to access, extract, reproduce or redistribute YB Tracking's proprietary databases, software, APIs or data feeds.

6.3 Where an event organiser appoints another tracking or mapping provider, that appointment does not automatically transfer any YB Tracking database rights, software rights, access credentials or data licences to the new provider.

6.4 Third parties wishing to use Tracking Data previously supplied by YB Tracking must obtain appropriate written authorisation unless such use is already permitted by an existing agreement or applicable law.

6.5 Nothing in these terms prevents event organisers, competitors or third parties from independently collecting, owning or using information lawfully obtained from sources other than YB Tracking.

7. API, XML Feeds and Data Licensing

7.1 Access to YB Tracking APIs, XML feeds, data exports, embedded services or other data delivery mechanisms is subject to express authorisation and any applicable licensing agreement.

7.2 Permission to receive or display Tracking Data does not automatically include permission to redistribute, sublicense, sell or provide that data to another party.

7.3 Authorised Partners must use Tracking Data solely for the purposes and duration specified in their applicable agreements.

7.4 Unless expressly authorised, API and data-feed recipients must not:

•    Provide Tracking Data to unauthorised third parties.
•    Create alternative public tracking services using YB Tracking data.
•    Resell or commercially exploit the data.
•    Retain or redistribute data beyond the scope of their licence.
•    Share access credentials or API keys with unauthorised parties.

7.5 YB Tracking may impose reasonable technical restrictions, usage limits, authentication requirements and security measures on access to its APIs and data feeds.

7.6 YB Tracking may suspend or revoke access where reasonably necessary to address security risks, unauthorised use or a material breach of the applicable agreement, subject to any contractual notice requirements.

8. Technical Protection Measures

8.1 YB Tracking may use technical measures to protect the security, integrity and commercial value of its Services and databases.
These measures may include access controls, authentication, rate limiting, bot detection, request monitoring, data delays and technical identifiers designed to identify unauthorised extraction or redistribution.

8.2 YB Tracking may modify the format, availability, frequency, resolution or delay of publicly displayed Tracking Data where reasonably necessary for operational, security, contractual or commercial reasons.

8.3 Users must not attempt to bypass or interfere with these measures.

8.4 The use of technical identifiers and monitoring measures involving personal data will be subject to applicable data protection legislation and YB Tracking's Privacy Policy.

9. Monitoring and Enforcement

9.1 YB Tracking may monitor access to its Services for security, operational integrity and the detection of suspected unauthorised data extraction or misuse.

9.2 Such monitoring may include IP addresses, user agents, access logs, request frequency and other relevant technical information, processed in accordance with applicable data protection legislation.

9.3 Where YB Tracking reasonably believes that these terms have been breached, it may take proportionate action, including:

•    Restricting or suspending access to the Services.
•    Revoking API keys or data-feed permissions.
•    Requiring unauthorised use or redistribution to cease.
•    Requesting deletion of unlawfully obtained or improperly retained Tracking Data.
•    Notifying relevant hosting providers, platforms or service operators of suspected infringement.
•    Pursuing available legal remedies.

9.4 Where appropriate, YB Tracking may seek injunctive relief, damages, an account of profits or other remedies available under applicable law.

9.5 Recovery of legal costs and other expenses will be subject to applicable law, contractual rights and any relevant court order.

9.6 Commercial users and Authorised Partners may be subject to additional liability, indemnity and enforcement provisions under their separate written agreements.

10. Availability and Accuracy of Tracking Data

10.1 Tracking Data is provided for event monitoring, race presentation and general information purposes.

10.2 Although YB Tracking takes reasonable steps to maintain accurate and timely information, satellite communications, GPS reception, equipment performance, environmental conditions and other factors may affect the accuracy, frequency or availability of reported positions.

10.3 Tracking Data may be delayed, incomplete or temporarily unavailable and should not be treated as a guaranteed real-time representation of a vessel's or participant's location.

10.4 Unless expressly agreed otherwise in writing, the public Race Viewer and associated Tracking Data are not intended to replace official race management systems, navigational equipment, emergency communications or dedicated safety procedures.

10.5 Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

11. Changes to These Terms

11.1 YB Tracking may update these terms from time to time to reflect changes in its Services, technology, commercial arrangements or legal requirements.

11.2 The current version will be published on the YB Tracking website with its effective date.

11.3 Where material changes affect registered users or commercial licensees, YB Tracking will provide reasonable notice where required by law or the applicable agreement.

11.4 Continued use of the Services following the effective date of updated terms will be subject to applicable law and any requirements for notification or acceptance.

12. General Provisions

12.1 If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

12.2 Failure or delay by YB Tracking to enforce any provision does not constitute a waiver of its rights.

12.3 No rights or licences are granted except as expressly stated in these terms or an applicable written agreement.

12.4 These terms do not affect any mandatory statutory rights available to consumers.

12.5 Except where expressly provided by law, no third party has the right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.

13. Governing Law and Jurisdiction

13.1 These terms are governed by and interpreted in accordance with the laws of England and Wales.

13.2 Subject to any mandatory consumer rights or applicable jurisdictional rules, the courts of England and Wales shall have exclusive jurisdiction over disputes arising from these terms.

13.3 YB Tracking reserves the right to seek appropriate remedies for intellectual property infringement or unauthorised data use in any jurisdiction where such remedies are lawfully available.

13.4 Consumers residing in Scotland or Northern Ireland retain any applicable rights to bring proceedings in their local courts.
